1. Acceptance of Terms

By creating an account, accessing our website, or using any TokKaTok services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy.

Eligibility

You must meet the following requirements to use our services:

  • Be at least 18 years old (or the age of majority in your jurisdiction)
  • Have the legal capacity to enter into a binding agreement
  • Provide accurate and complete information during registration
  • Comply with applicable laws and regulations

Account Registration

You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

2. Platform Overview

TokKaTok is an online platform that connects property owners ("Hosts") with travelers seeking accommodations ("Guests"). We facilitate these connections but are not a party to the rental agreements between Hosts and Guests.

Our Role

  • Provide the platform for listings and bookings
  • Process payments and facilitate communication
  • Offer customer support and dispute resolution
  • Maintain safety and security measures

Third-Party Services

Our platform may integrate with third-party services for payments, identity verification, and other functions. Your use of these services is subject to their respective terms and conditions.

3. User Accounts

Account Security

You are responsible for:

  • Maintaining the confidentiality of your login credentials
  • All activities that occur under your account
  • Notifying us immediately of unauthorized account access
  • Ensuring your account information remains accurate

Identity Verification

We may require identity verification before you can host or book properties. You agree to provide requested documentation and consent to background checks where permitted by law.

Account Types

  • Guest Accounts: For users seeking to book accommodations
  • Host Accounts: For users listing properties for rent
  • Dual Accounts: For users who both host and book properties

4. Booking and Payments

Booking Process

  • All bookings are subject to Host approval unless marked as "Instant Book"
  • Payment is processed when a booking is confirmed
  • Booking confirmations create binding agreements between Hosts and Guests
  • Special requests and modifications require mutual agreement

Payment Terms

  • Guests pay the total booking amount plus applicable fees
  • Hosts receive payment after guest check-in, minus our service fees
  • All payments are processed through our secure payment system
  • Refunds are subject to applicable cancellation policies

Pricing and Availability

Hosts set their own prices and availability. Prices may include taxes and fees as determined by the Host and applicable law. We reserve the right to display prices in different currencies for user convenience.

5. Host Responsibilities

Listing Requirements

As a Host, you must:

  • Provide accurate descriptions and photos of your property
  • Disclose all material defects or safety issues
  • Maintain appropriate licenses and permits
  • Comply with local laws and regulations
  • Honor confirmed bookings unless exceptional circumstances occur

Property Standards

  • Ensure properties are clean, safe, and habitable
  • Provide advertised amenities and services
  • Maintain adequate insurance coverage
  • Respond promptly to guest inquiries and issues

Legal Compliance

Hosts are responsible for complying with all applicable laws, including housing regulations, tax obligations, zoning laws, and safety requirements.

6. Guest Responsibilities

Respectful Use

As a Guest, you must:

  • Treat the property and neighbors with respect
  • Follow all house rules and property guidelines
  • Report any damages or issues immediately
  • Ensure guest count does not exceed booking limits
  • Leave the property in the same condition as found

Communication

  • Respond promptly to Host communications
  • Provide accurate arrival and departure information
  • Notify Hosts of any special requirements or concerns
  • Use our platform messaging system for booking-related communications

Prohibited Activities

Guests may not use properties for illegal activities, unauthorized events, or purposes that violate local laws or property restrictions.

7. Prohibited Activities

The following activities are strictly prohibited on our platform:

Illegal or Harmful Activities

  • Violating any applicable laws or regulations
  • Engaging in discriminatory practices
  • Harassment, threats, or violent behavior
  • Drug trafficking or illegal substance use
  • Money laundering or fraud

Platform Misuse

  • Creating false or misleading listings
  • Manipulating reviews or ratings
  • Circumventing our fee structure
  • Unauthorized commercial use
  • Automated scraping or data collection

Enforcement

Violation of these prohibitions may result in account suspension, termination, legal action, and cooperation with law enforcement authorities.

8. Fees and Taxes

Service Fees

  • Guest Service Fee: Charged to guests on each booking
  • Host Service Fee: Deducted from host earnings
  • Payment Processing Fees: May apply to certain payment methods
  • Additional Fees: May apply for special services or features

Tax Responsibilities

Users are responsible for determining and paying applicable taxes. We may collect and remit certain taxes where required by law, but this does not relieve users of their tax obligations.

Fee Changes

We reserve the right to modify our fee structure with reasonable notice. Changes will not affect bookings already confirmed at the time of notice.

9. Cancellations and Refunds

Cancellation Policies

Hosts may choose from several cancellation policies:

  • Flexible: Full refund until 24 hours before check-in
  • Moderate: Full refund until 5 days before check-in
  • Strict: 50% refund until 7 days before check-in
  • Super Strict: 50% refund until 30 days before check-in

Extenuating Circumstances

We may provide full refunds for bookings affected by circumstances beyond the user's control, such as natural disasters, government restrictions, or serious illness.

Host Cancellations

Hosts who cancel confirmed bookings may face penalties including automatic refunds to guests, calendar blocking, and account restrictions.

10. Content and Intellectual Property

User Content

You retain ownership of content you post but grant us a license to:

  • Display your content on our platform
  • Use content for marketing and promotional purposes
  • Make technical modifications for platform functionality
  • Remove content that violates our policies

Platform Content

Our platform, including software, design, text, and graphics, is protected by intellectual property laws. You may not copy, modify, or distribute our content without permission.

DMCA Compliance

We respond to valid DMCA takedown notices. If you believe your copyrighted work has been infringed, please contact our designated agent.

11. Liability and Disclaimers

Platform Disclaimers

Our platform is provided "as is" without warranties of any kind. We do not guarantee the accuracy of listings, availability of properties, or conduct of users.

Limitation of Liability

To the maximum extent permitted by law, TokKaTok shall not be liable for indirect, incidental, special, or consequential damages arising from your use of our services.

User Responsibility

Users interact at their own risk. We recommend verifying property details, reading reviews, and taking appropriate precautions when traveling.

Insurance Recommendation

We strongly recommend that all users maintain appropriate insurance coverage for their activities as hosts or guests.

12. Dispute Resolution

Internal Resolution

We provide mediation services for disputes between users. Our support team will review evidence and may make binding decisions regarding refunds and resolutions.

Arbitration Agreement

Any disputes arising from these Terms or your use of our services shall be resolved through binding arbitration rather than court proceedings, except where prohibited by law.

Class Action Waiver

You agree not to participate in class action lawsuits against TokKaTok. Disputes must be resolved individually through arbitration.

13. Termination

Account Termination

You may terminate your account at any time by:

  • Canceling all active bookings
  • Settling outstanding financial obligations
  • Requesting account deletion through our platform

Our Right to Terminate

We may suspend or terminate accounts for:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Threat to user safety
  • Non-payment of fees

Effect of Termination

Upon termination, your right to use our services ceases immediately. Surviving provisions include payment obligations, liability limitations, and dispute resolution terms.

14. Governing Law

These Terms are governed by the laws of the Republic of the Philippines. Any legal proceedings shall be conducted in the appropriate courts of Metro Manila, Philippines.

International Users

Users accessing our services from outside the Philippines do so on their own initiative and are responsible for compliance with local laws.

15. Changes to Terms

We may modify these Terms at any time by posting updated terms on our platform. Material changes will be communicated through:

  • Email notifications to registered users
  • Platform notifications upon login
  • Prominent notices on our website

Continued use of our services after changes take effect constitutes acceptance of the modified Terms.
